TOUR BOOKING AGREEMENT
TERMS AND CONDITIONS
Casara Travel Enterprises, Inc., doing business as Friendship Tours is a tour operator providing all-inclusive Christian and Jewish Tours of religious importance. Please read the following terms and conditions carefully. These terms and conditions together with our privacy policy, release, and any other documentation we provide you form the basis of your contract with us (hereinafter The Agreement). This Agreement effects your legal rights. By booking a tour with us, you are accepting and consenting to The Agreement. If you do not agree to the Terms and Conditions, you must not make any booking with us.
The terms “we”, “us”, “our”, and “Friendship Tours” refer to Casara Travel Enterprises, Inc., doing business as Friendship Tours. The term “you” “I” “participant” or “customer” refers to the customer booking a reservation through us. Reference to “Suppliers” and “Service Providers” means all third parties who provide services to you including airlines unless otherwise specified.
By making a booking with us, you affirm that you are at least 21 years of age and possess the legal authority to enter into this agreement in accordance with all Terms and Conditions herein. If you are making travel reservations or bookings for another person you agree to inform that person(s) about the Terms & Conditions that apply to the travel reservations and bookings you have made on their behalf, including all rules and restrictions applicable thereto and these Terms and Conditions. You agree to be financially responsible for all bookings you make. You are responsible for any bookings and travel reservations made by persons under your direction or control. You also warrant that all information supplied by you or on your behalf, or by members of your household is true, current, complete and accurate. Furthermore, you also confirm that the traveler is not an unaccompanied minor.
REGISTRATION AND PRICE
You must make payment for your arrangements in accordance with the instructions we give you. A deposit of $300 per person is required upon registration. The remaining balance is due 90 days prior to the departure date. Bookings made less than 90 days before departure must be paid for in full at the time of booking. If we do not receive any payment due in full and on time, we reserve the right to treat your booking as cancelled by you in which case the cancellation charges set out below will become payable. We reserve the right to refuse a booking without giving any reason and shall in that event return any deposit received. Reservations are non-transferrable.
Our tours are custom tours and the cost quoted to you is based on a minimum number of participants, as outlined in the registration booking form. Should tour membership fall below this number, the tour operator reserves the right to re-cost the program.
Prices are based on airfares, tariffs and rates of exchange effective at the time of your booking. All airfares are subject to change.
Prices are based on double occupancy. There will be a supplemental charge of $878 for each request for a single room.
PRICE INCLUDES
- Round trip jet economy class
- First Class Hotels. Accommodations based on two persons sharing a room
- Full Buffet-Breakfast & dinner daily
- Transfers by private motor coach including a qualified, licensed English-speaking guide
- Porterage for one suitcase per person not to exceed 50 pounds.
- Airport taxes & airline fuel surcharges of $650 per person, subject to change
- Love offering for guides, driver, restaurant staff and housekeeping staff.
NOT INCLUDED IN THE TOUR PRICE
Any items and matters not referred to above, including, air-related taxes and fees (except where specified); additional fees charged by airlines such as checked and/or excess baggage, seat selections and any other services; passport and visa fees; insurances of all kinds; laundry; phone calls; minibar; beverages and meals not detailed in the itinerary; Optional Experiences; and all items of a personal nature. Additional taxes and surcharges may be collected by foreign governmental and non-governmental entities. The price does not cover costs and expenses, including your return home, if you leave the guided holiday/vacation whether of your own volition, our decision based on behavior that disrupts the trip, due to illness, action by any government or other reason. This list is illustrative and not a complete list of every item not included.
CANCELLATIONS BY YOU:
All cancellations must be in writing. Special note for all passengers using our airfare: Any cancellations received 91 days or earlier prior to departure will incur an additional $100 cancellation charge over and above the charges stipulated under the normal cancellations for this tour. For individual cancellations received up to:
- 91 days prior to departure an administrative fee of $200 will be charged;
- 90-60 days prior to departure a $450 fee will be charged;
- 59-46 days prior to departure a $850 fee will be charged;
- 45-31 days before departure are subject to a charge of 40% of the total tour cost;
- 30-0 days before departure are subject to a charge of 100% of the total tour cost.
CANCELLATION OR RESCHEDULING BY TOUR GUIDE OR OTHER
In the event the Tour Leader or other entity associated with the Tour Guide chooses to change the departure date, the standard cancellation charges remain effective for the original departure date. Cancellation of a tour without Friendship Tours’ consent is subject to standard cancellation charges.
CANCELLATION BY FRIENDSHIP TOURS
Friendship Tours reserves the right to cancel any tour at its sole discretion. In the unlikely event a tour is canceled by Friendship Tours and Friendship Tours is unable to reschedule, except in the case of force majeure as described below, all funds collected from any participant will be promptly refunded in full. Money is refunded to the original payer.
FORCE MAJEURE
We cannot accept liability or pay any compensation where the performance or prompt performance of our contractual obligations is prevented or affected, or you otherwise suffer any loss, injury, death, inconvenience or damage as a result of circumstances amounting to “force majeure”. “Force majeure” means any event or circumstances which we or the supplier of the services in question could not foresee or avoid. Such events and circumstances may include, acts of God, actual or threatened, war, insurrection, riots, strikes, civil action, decisions by governments or governing authority, technical or maintenance problems with transport, changes of schedules or operational decisions of air carriers, terrorist activity or the threat thereof, industrial action, natural or nuclear activity, epidemic, illness, physical injury, quarantine, medical or customs or immigration regulation, delay, or cancellation, adverse weather conditions, fire and all similar events outside our control.
DOCUMENTS
By offering reservations for travel in particular international destinations, Friendship Tours does not represent or warrant that travel to such areas is advisable or without risk. It is your responsibility to be aware of travel warnings and advisories as announced by the U.S. State Department. Should you choose to travel to a country that has been issued a travel warning or advisory, Friendship Tours will not be liable for damages or losses that result from travel to such destinations.
You and any minors traveling with you must be in possession of a machine-readable passport valid for 6 months after their trip return date along with applicable visas. Some countries require that your passport have two to four blank visa/stamp pages. Some airlines will not allow you to board if this requirement is not met. For information about passport requirements you can visits the State Department’s website at https://travel.state.gov/content/travel/en/passports.html. It is your sole responsibility to secure and/or pay for any and all visas, reciprocity fees, affidavits, immunizations, etc. that are required to be permitted entry into each destination. In some countries you may be subject to entry (reciprocity) fees and/or departure taxes/ exit fees which will be collected at the airports upon entry/departure by local government authorities. Please note that entry to any country may be refused even if the required information and travel documents are complete.
For up-to-date detailed information on travel documents and visas, entry/exit taxes and further information on entry and exit requirements please check with your local consular services. Obtaining and carrying these documents is your sole responsibility. Friendship Tours bears no responsibility for such information and will not be responsible for advising and/or obtaining required travel documentation for you, or for any delays, damages, and/or losses including missed portions of your vacation related to improper documentation or government decisions about entry.
Health: Recommended inoculations for travel may change and you should consult your doctor for current recommendations before you depart. It is your responsibility to ensure that you meet all health entry requirements, obtain the recommended inoculations, take all recommended medication, and follow all medical advice in relation to your trip. Inoculation requirements can be found on the Center for Disease Control website at https://www.cdc.gov/.
Disinsection: Most countries reserve the right to disinsect aircraft if there is a perceived threat to public health, agriculture, or environment. While this is not a common practice, we want you to be aware that it is a possibility. This process includes the following: (1) spray the aircraft cabin with an aerosolized insecticide while passengers are on board or (2) treat the aircraft’s interior surfaces with a residual insecticide while passengers are not on board. AIRLINE INFORMATION
SEAT ASSIGNMENT: Random seats are assigned for all group participants. If you would like to secure a specific seat, or sit with a travel companion please advise us of such request at the time of booking, we will make an effort to accommodate you, however we cannot guarantee. If you must have specific seat, we recommend you to be at the airport at least three hours prior to departure and arrange the seat assignment with your airline’s gate agent. Bulkhead and exit row seating can never be requested prior to the day of departure. Friendship Tours can NEVER guarantee any specific seats. Seats are at the sole discretion of the airline and are pending availability.
AIRPORT TAXES, SECURITY FEES AND FUEL CHARGES: Airport taxes are collected at the time of final payment and paid to the airlines on your behalf at the time of ticketing. Please note that unless airline ticket has been paid for and issued, airport taxes are subject to change.
BAGGAGE: International flights to and from the USA allow the passenger to bring one (1) checked bag, which may have a maximum weight of 50 pounds, and maximum combined dimensions of 62 inches. Also, one (1) “carry-on” with maximum dimensions of 8″x12″x20″ is permitted. Luggage on domestic flights will cost extra. Luggage is the passenger’s responsibility and that of the airlines. For lost luggage, the passenger is responsible for notifying the airline directly. Check with your carrier regarding carry-on luggage rules and regulations. Baggage allowances may change and the guest will be responsible to check airline requirements for allowable baggage and will be responsible for any additional charges.
SPECIAL NOTICE: Delays, cancellations and overbooking may occur on air flights, cruises and land reservations by the participating carriers and hotels. While Friendship Tours will do everything possible to avoid these inconveniences, it cannot and will not assume responsibility for the respective carriers and hotels.
PRE-EXISTING MEDICAL CONDITIONS/PERSONS WITH DISABILITIES
The nature of many of the destinations we travel to means that in some cases they may be unsuitable for those who use a wheelchair or have a lack of mobility. However, we will be delighted to discuss the feasibility of creating a tailor-made itinerary for you that takes into consideration your level of mobility.
It is essential that you advise us before booking if you do have any disability or pre-existing medical condition which may affect your trip, or if you have any special requirements as a result of any disability or medical condition (including any which affect the booking process) so that we can assist you in considering the suitability of the arrangements and/or in making the booking. It will also enable us to make sure you receive the relevant level of assistance when you fly. Full details must be confirmed in writing at the time of booking and whenever any change in the condition or disability occurs. Friendship Tours will make all reasonable efforts to accommodate requests, but cannot be responsible if ADA accommodations are not available. Any accommodations provided will be at the sole expense of the guest requiring the accommodation. Please note that accommodations outside of the USA may not be in compliance with the Americans with Disabilities Act and may not have wheelchair accessibility.
The tour guides and tour leaders are, unfortunately, unable to offer additional assistance to passengers with limited mobility and all such assistance will need to be provided by whoever the passenger is traveling with. Participants with disabilities must notify Friendship Tours in writing no later than the time of booking of status and of the identity of their non-discounted, paid travel companion who will be responsible for providing all necessary assistance. We may request that you provide a letter from your doctor confirming your fitness to travel.
SPECIAL DIETARY REQUIREMENTS
Special diets should be requested on the Friendship Tours booking form; however, it may not be possible for special diets to be catered to in some of the destinations we feature. For safety and liability reasons, Friendship Tours and its representatives cannot be responsible for directly accommodating any food allergies, or dietary requirements and restrictions, and is not responsible for any issues or problems associated with the same. We will advise the hotels and airlines of your request but we cannot guarantee their availability.
TRAVEL PROTECTION
We strongly recommend that passengers purchase comprehensive insurance that includes coverage for Trip Cancellation or Interruption, Medical Expense, Emergency Evacuation/Repatriation, and Baggage. Such insurance at a minimum should cover your losses sustained as a result of cancellation, medical issues, and repatriation in the event of accident or illness. Certain countries have a requirement for foreign visitors to have valid medical insurance on entry. Friendship Tours cannot be held responsible for denied entry if a guest is unable to provide details to authorities of insurance or denial of entry for any reason.
An optional travel insurance plan is available to Friendship International Tour Participants. Information about this plan will be sent with your deposit confirmation. Allianz Insurance Plan payment must be received no later than your final tour payment, or it will not be accepted. The Allianz Insurance Plan is not in force until the premium is received. Friendship Tours is not qualified to answer technical questions about the benefits, exclusions, and conditions of travel insurance plans. Friendship Tours cannot evaluate the adequacy of the prospective insured’s existing insurance coverage. If you have any questions about your travel protection, call your insurer or insurance agent or broker.
Declining travel insurance could result in the loss of your travel cost and/or require more money to correct the situation. You also acknowledge that without insurance, there may be no way to recoup any losses, costs or expenses incurred. If you choose to travel without adequate insurance coverage, we will not be liable for any of your losses howsoever arising, for which insurance coverage would otherwise have been available.
NON-RESPONSIBILITY
Casara Travel Enterprises, Inc., doing business as Friendship Tours and its employees, shareholders, representatives, and agents (hereinafter “Friendship Tours”) is a tour operator and uses third-party suppliers to arrange hotel accommodations, sightseeing, tours and transportation, whether by air, railroad, motorcoach, steamship, boat or other means. Friendship Tours is an independent contractor and is not an employee, agent or representative of any of these suppliers. Friendship Tours does not own, manage, operate, supervise, or control any transportation, vehicle, airplane, hotel or restaurants, or any other entity that supplies services related to your tour. Friendship Tours is not affiliated with any other tour operator. All suppliers are independent contractors, and are not agents or employees or representatives of Friendship Tours. All tickets, receipts, coupons, and vouchers are issued subject to the terms and conditions specified by each supplier, and by accepting the coupons, vouchers, and tickets, or utilizing the services, all customers agree that neither Friendship Tours, nor its employees, agents, or representatives are or may be liable for any loss, injury, or damage to any tour participant or their belongings, or otherwise, in connection with any service supplied or not supplied resulting directly or indirectly from any occurrence beyond the control of Friendship Tours. Therefore, Friendship Tours, hold themselves free of responsibility for any damage(s) from any cause(s) whatsoever. The tour operator will not be responsible for any damage, expense or inconvenience caused by late air, rail or boat arrivals or departures or by any change of schedules or other conditions; nor will they be responsible for the loss of, or damage to baggage or any article belonging to the passenger. The right is also reserved to decline to accept or retain any person traveling under our auspices. The carriers concerned are not to be held responsible for any act, omission or event during the time passengers are not on board their plane or conveyance. The passenger contract used by the carriers concerned, when issued, shall constitute the sole contract between the carriers and the purchasers of this tour and/or the passengers. The Tour Operator and their agents and suppliers reserve the right to change the sequence of the itinerary to re-route, substitute or change certain site visits according to local conditions at the time of our stay.
ADDITIONAL RISKS
Additional risks and dangers may arise including, but not limited to, hazards of travel by train, automobile, motor coach, aircraft and other means of conveyance, animal interactions, forces of nature, political unrest, other unrest, risks associated with water, food, plants, insects and differing animal regulation, and acts of national and local governments and unrest and acts of others against governments. These risks are not an exhaustive list but are examples of many kinds of risks. You are voluntarily participating in these activities with the knowledge that there are significant dangers involved, and you hereby agree to accept any and all risks. As lawful consideration for the agreement with Friendship Tours to participate in such trips and activities you agree you will not make a claim against Friendship Tours, its related companies or its personnel or sue for bodily injury, emotional trauma, death, property loss or damage or other loss, cost or expense, however caused, as a result of or related to your contracting for, traveling to or from, or in any and every other way participating in the trip. You release Friendship Tours, its related companies and its personnel from any and all claims, known or unknown, arising from contracting for, traveling to or from, and in any and every way participating in a trip. This release of liability and assumption of risk agreement is entered into on behalf of you and all members of your family and party, also including minors. This agreement also binds your heirs, legal representatives and assigns.
Where the guest occupies a motor coach seat fitted with a safety belt, neither Friendship Tours nor the Operator nor its agents or co-operating organizations or service providers will be liable for any injury, illness or death or for any loss or damages or claims whatsoever arising from any accident or incident, if the safety belt is not being worn at the time of such an accident or incident. This exclusion and limitation of liability shall not be used to imply that the Operator or its agents or affiliated entities are liable in other circumstances.
YOUR CONDUCT
Each participant is expected to act responsibly and adhere to all behavior guidelines established by Friendship Tours and our local ground-handlers. We and our local ground-handlers reserve the right to remove you from any trip if you endanger yourself or others or disrupt the general well-being of the trip itself. In any such case, there will be no refund.
When you book with us, you accept responsibility for any damage or loss caused by you. Full payment for any such damage or loss (reasonably estimated if not precisely known) must be paid direct at the time to the accommodation owner or manager or other supplier. You must indemnify us for the full amount of any claim (also including legal costs) made against us. Friendship Tours is not responsible for any costs incurred concerning a guest removed from a vacation/holiday. Guests agree not to hold Friendship Tours or any of its related entities liable for any actions taken under these terms and conditions.
Baggage and personal effects are at all times the sole responsibility of the participant.
BROCHURE AND CUSTOM ITINERARY ACCURACY
We thoroughly check all the information that is included within our brochures and custom itineraries; however, changes do occur and errors are occasionally made. Airlines may change their schedules; roads may close and government regulations may change. Should there be any changes to the travel arrangements you have booked we will do our best to keep you informed prior to departure. Friendship Tours is not responsible for any typographic or printing error in any brochure, itinerary, confirmation, or related material. You must therefore ensure you check all details of your chosen trip (including the price) with us at the time of booking.
PHOTOGRAPHIC/VIDEOGRAPHIC LIKENESS
Friendship Tours may take photographs or video of its trips and trip participants. I grant Friendship Tours permission to do so and for it to use same for promotional or commercial use without payment of any compensation to participant.
SEVERABILITY
If any provision of these terms and conditions shall be held unenforceable, such provision shall be struck and the remainder shall remain enforceable.
JURISDICTION AND APPLICABLE LAW
These Booking Conditions and any agreement to which they apply are governed in all respects by the laws of the state of California without regard to conflicts of law principles. All guest claims must be submitted in writing and received by Friendship Tours no later than sixty (60) days after the completion of the Friendship Tours vacation. Guest claims not submitted and received within this time shall be deemed waived and barred.
